WKU Baseball Coach Gets DUI

WKU Baseball Coach Gets DUI: John Pawlowski, age 52, is presently the head baseball coach at Western Kentucky University.  Pawlowski previously held the head coaching position at Auburn and at the College of Charleston.  In 2009, Pawlowski lead Auburn to the most SEC victories in the history of the team.  Unfortunately that success did not carry over and Pawlowski was fired at the culmination of the 2013 baseball season.  Pawlowski played in the Major Leagues for the Chicago White Sox in 1987 and 1988.  He pitched in eight games.  He also played for the Baltimore Orioles and the Los Angeles Angels.

WKU Baseball Coach Gets DUI: Pawlowski was arrested for DUI by Bowling Green Law Enforcement in late January, 2016.   Pawlowski was held in jail overnight and released from the Warren County Regional Jail on a bond of $500.00.  Pawlowski’s lawyer reported on television that Pawlowski’s breath alcohol level was 0.021 well below the 0.08 grams per 210 liters legal limit.  The police also reported that Pawlowski failed multiple sobriety tests and admitted to drinking within a hour of being stopped.  Police came into contact with Pawlowski when he stopped for police emergency lights as the car behind him was pulled over.  The original driver was found not to have been drinking and was released.  Pawlowski however had red and glassy eyes, smelled of alcohol and reported fumbled with his proof of insurance documentation.  #WKUBaseballCoachGetsDUI

It appears that Pawlowski was arrested for DUI because he attempted the field sobriety tests.  Police officers are taught that the roadside gymnastics are perfect in determining impairment.  For that reason when an older person with a low breath alcohol level attempts them the Officer believes that some substance must be impairing the older person.  The typically young officers do not factor in arthritis, joint problems, balance issues from age and other age related maladies.  We always tell people to politely decline the standardized field tests because they are not accurate and rarely help the accused.

Top Staunton DUI Lawyer:  Even famous people can get charged with DUI.  In July of 2015, actually on his birthday, R&B Singer Jeremih got arrested for DUI.  Jeremih got pulled over by the California Highway Patrol after 2:00 a.m. on July 17, 2015 and was arrested as a result of their DUI Investigation.

Jeremih, born Jeremih Felton is a singer, producer and writer.  Jeremih’s breakout single was Birthday Sex.  Jeremih has signed as a producer with Def Jam.  His first album was Jeremih.  He followed that with All About You and the single Down on Me.  Another favorite is Don’t Tell Them.

Jeremih probably did not understand that he needed to assert his constitutional rights to ensure that he was treated fairly and afforded a fair trial on the DUI.  When stopped, Jeremih should have simply handed the Officer his license and registration and said, “I want a Lawyer.  If I am not under arrest, please let me go.”  This is all contained on Bob’s FREE App.

Staunton DWI Lawyer: Simply being charged with DWI can have a significant effect on the Accused’s life.  For example, Kimberly J. Allen was the Athletic Director for the University of New England.  In mid-January, 2015 Ms. Allen was arrested and charged with driving under the influence.  Ms. Allen resigned her position as Athletic Director shortly thereafter.  Even though she had not had her trial and even though our system claims the Accused is innocent until proven guilty, Ms. Allen’s employer the University of New England received her resignation.  The University noted that her resignation was her own decision.  The University did not elaborate on what other options the University had given her.

Staunton DWI Lawyer:  According to the media, Ms. Allen, who is 52 years old, has no traffic or criminal history other than a speeding ticket in 2012.  Ms. Allen had been at the University for nine years and was previously Athletic Director from 2006 to 2011.  In 2011, the University began a 19 month suspension due to NCAA violations concerning or related to scholarship fraud and the recruitment of Canadian Hockey Players.  Division 3 Schools are not permitted to award sports scholarships.

Staunton DWI Lawyer:  Before her tenure at the University, Ms. Allen had been Associate Athletic Director at Smith College and had also worked at Rutgers-Newark.  In addition to losing her job, Ms. Allen apparently faces a $500.00 fine, mandatory alcohol education and a 150 day loss of license in Maine for a first offender operating under the influence.  The media did not see the need to discuss whether there was a reason to stop Ms. Allen, a reason to arrest Ms. Allen and what proof of being under the influence the Government had against Ms. Allen.

Best Staunton DWI Lawyer:  The Federal Government has launched a War on Driving Under the Influence of drugs and alcohol.  Anyone and everyone is a target of this War.  One recent casualty of that war is eighteen year old Nadji Jeter.  Jeter is a dancer, an actor and a musician.  He has been working on show business since his early childhood.  Jeter was the Coke Drink symbol in 2011.  Jeter was the dancing mascot for the Atlanta Hawks, “Lil Harry the Hawk”.

Best Staunton DWI Lawyer:  Jeter was stopped for aggressive driving and speeding.  Jeter was apparently not consuming alcohol however the Officer believed that he had consumed marijuana due to smell.  The Officer gave Jeter field tests designed to detect a blood alcohol content in excess of the legal limit.  The field tests are not impairment tests.  Based on the smell and tests not designed to demonstrate anything about marijuana Jeter was arrested for driving under the influence of marijuana.

Best Staunton DWI Lawyer:  Marijuana is a tough drug to test for because it has a very short half life where it causes impairment.  This is another difference with alcohol which is linear and does not come and go in half lives.
